Terms & Conditions

These terms and conditions of trading apply to all supply contracts between Simply Improve Ltd (hereinafter referred to as the company or we or us) and the person or persons named as the customer (hereinafter referred to as the customer or you) in relation to all sales of goods and services with the exception of sales made via the internet or web for which separate terms exist.

1 Services: services typically will consist of technical survey, sourcing of goods required for the contract and delivery of goods to the address on the contract.

2 Product specification

2.1 We have a policy of continuous product development and reserve the right to amend the specification of the product without prior notice in relation to future sales.
2.2 Goods supplied may differ as a consequence from those displayed or advertised. Unless agreed with you the goods supplied will be of equivalent value, functionality or appearance. Any significant variation will be highlighted at technical survey or prior to delivery and acceptance of the delivery will be deemed to be an acceptance of the change made.
2.3 Some kitchen or bathroom furniture is made from natural wood and accordingly apearance may vary.

3 Measurements

3.1 We will not accept liability for any extra cost incurred by you as a result of incorrect or incomplete measurements or information supplied by you.
3.2 In the event that you are supplying material we will endeavour to assist you in measurement and sizes however no liability for any extra cost that you may incur due to inaccurate measurements supplied or assisted by us will be accepted by the company.
3.3 The measurement and sizes of all furniture supplied by us will be as accurate as possible, but are never less approximate.
3.4 Where you are supplying goods then it will be at the project manager’s discretion if we arrange uplift and delivery of goods supplied by you and will not form part of the contract unless otherwise stated on the contract. In some instances a delivery and uplift charge may be applied.

4 Payment

4.1 In most cases, a deposit will be required to be paid at point of order; some goods will require payment in full at this point.
4.2 The balance must be paid in full on the date of delivery, either by cheque, banker’s draft or cash.
4.3 The pricing of the goods will remain fixed for a period of six months from the date of the deposit; all balances must be paid in full in this period. Failing this we retain the right to cancel the contract or offer a revised price. An administration charge of typically 20% of the contract value would typically be chaged with the balance of the deposit being returned to you if an agreement on the new price could not be reached between you and us.
4.4 Where payment is made by credit or debit card the transaction will be processed with surcharge of 2.5% for each transaction.

5 Delivery

5.1 Your estimated delivery date shown on your order will become the delivery date after consultation with our project manager. We will advise if this delivery date cannot be met and a mutually agreed delivery date will be set.
5.2 Any changes from the original sales order may impact the delivery date.
5.3 If we accidentally damage goods in the course of delivery, then our liability will be limited to repair, replacement or refund of the goods or the value thereof.
5.4 Time of delivery is not the essence of the contract. We will not be liable for any direct or indirect costs suffered by you as a result of late delivery.

6. If you decide within 5 days from the date of your initial order that you do not wish to continue with the contract then you may do so without charge. After this 5 day period you may still cancel the contract but we will retain 10% of the contract value unless we have “made to measure” any goods. In this circumstance full payment for those goods will be subtracted form the initial deposit plus 10% of the contract value. Where you are using one of our financial packages then the above time period is increased to 7 days. In any circmstance that you have taken delivery of the goods then you have waived your right to cancel and no refund will be given.

6.1 We reserve the right to cancel any agreement after a technical survey has been done and we believe that the site or sales order is unsatisfactory.

7 We guarantee the goods supplied for a period of 12 months after date of delivery although many of the goods supplied have longer manufacturer’s guarantee. Written confirmation of these guarantees will be issued on request. Our guarantee will be issued after receiving full payment for goods as per contract. Failure to make payment in full for delivery will make our guarantee void.

7.1 Claims under our guarantee will be limited to the supply of goods and we will not be held liable for faulty or improper installing, misuse or damage. In the unlikely event of finding any of the goods supplied by Simply Improve Ltd faulty or not fit for the purpose described then please contact our Customer Service helpline stating name, address, date of supply of goods and a brief description of the fault. Where necessary we will visit the intstallation to ascertain the nature of the fault and will arrange at no extra cost to you for refund, repair or replacement of goods. We will not be liable for any other cost incurred by you regarding the fault of the goods.

8 Data protection: Simply Improve Ltd is a registered data controller in accordance with data protection act of 1988.
We process your personal data in accordance with the act.

9 This contract shall be construed according to the law of Scotland.

10 Any dispute arising between the company and the customer in connection with the construction or performance of this contract shall be determined by the appropriate Scottish Courts and the parties agree that the Scottish courts will have sole jurisdiction to determine such disputes and they exclude the jurisdiction of any other court. In the event that the customer is located outwith Scotland the parties, by entering into the contract, agree to probate the jurisdiction of Glasgow Sheriff Court.

All terms and conditions are subject to and in accordance with The Sale Of Goods Act 1979 (as amended). Your statutory rights remain unaffected.
